Unfortunately, accidents are a part of life. According to the Florida Highway Safety and Motor Vehicles Department, in 2019, on average, there were about 1,101 car accidents per day in the state of Florida. But just because they are frequent doesn’t mean you should go without compensation.

A negligent or reckless driver who causes an accident may be liable for a wide variety of damages including but not limited to the following:

You may also recover damages for physical pain, disfigurement and discomfort, disability from engaging in work or recreational activities, any type of mental or emotional distress or trauma you suffer as a result of the accident, such as fear, anxiety, grief, shock, PTSD, loss of dignity, loss of enjoyment of life, and embarrassment or humiliation caused by your scars, disabilities, or other injuries.

LOSS OF EARNINGS AND EARNING CAPACITY: You can recover damages for the amount of money you would have earned between the time of your injury and the settlement or judgment including damages for your earning capacity if your ability to earn money has been effected by the accident.

MOTOR VEHICLE FAQ

WHAT TO DO AFTER A TRAFFIC ACCIDENT?

Safety is the number one priority after an accident:

Are you and your passengers okay?

Contact the police and call for an ambulance if necessary.

Is your car in a safe location? If not, can it safely be moved to a better location?

Check to see if others need help.

Do not talk to anyone about the accident other than emergency personnel.

Never accept blame or fault for the accident. You may be unaware of all factors that contributed to the accident (did a tire blowout, was the driver of the other car texting etc…).

WHAT INFORMATION SHOULD I OBTAIN FROM THE OTHER DRIVER IMMEDIATELY FOLLOWING A CAR ACCIDENT?

The immediate aftermath of a car accident can be hectic. It is important to stay calm and remember to collect the information of the other driver involved in the accident, otherwise you may not be able to hold him or her accountable if they are at fault. It is recommended that drivers collect the following information at the accident scene:

Name

Address

Phone number

Insurance company

Policy number

Driver’s license number

License plate number

In some cases the driver with which you were involved in an accident is not the vehicle’s owner. In that case, be sure to find out to whom the vehicle is registered, and clarify the relationship between the driver and owner before you get the name and address for both individuals.

HOW DOES MT ATTORNEY GET PAID?

Dos Santos Law operate on a contingency fee basis, which means you only pay us if and when we win your case. Our fee would come in the form of a percentage of the settlement or verdict amount we obtain.

HOW LONG WILL MY LAWSUIT TAKE?

The complexity of the accident as well as the particular injuries sustained will determine the time frame of the outcome. We resolve our client’s cases based on an understanding of their current and future medical conditions. Usually victims must have completed treatment for injuries before a case can be resolved. Once our law firm becomes involved, the average car or auto accident case is resolved within eight to 12 months.

WHAT IF I WAS PARTLY AT FAULT IN THE ACCIDENT?

If you were partly at fault, your burden of responsibility in the accident will be taken into account if and when we take on your case. Bearing part of the responsibility of the accident can limit the amount of compensation you obtain in a settlement or verdict, but it does not automatically eliminate your eligibility for compensation. Whichever party bears the brunt of the responsibility is responsible for compensating the victims for damages.
